Capitalized terms have the meanings provided in this Section or otherwise defined in these Terms. The definitions apply regardless of whether terms appear in singular or plural.
1.2 Definitions
- Application means the mobile application titled "Fuse" for health tracking and wellness, including all related features and updates.
- Service means, collectively, the Application, the Website, associated software, content, AI-powered tools, and any services we offer.
- User Content means any images, photographs, text, metadata, or other content uploaded, submitted, or transmitted by you through the Service.
- You means the individual using the Service or the legal entity on whose behalf the individual uses the Service.
2. Agreement to Terms
By accessing and using our services, including the Fuse health tracking application, you agree to be bound by these Terms of Service. Your access to and use of the Service is conditioned upon your acceptance of these Terms and our Privacy Policy. If you do not agree to these terms, please do not use our services.
3. Description of Services
We provide AI-powered health and wellness solutions, including the Fuse consumer application for health tracking and related services.
4. Eligibility; Age Requirements
You represent and warrant that you are at least 13 years old. If you are between 13 and 17 years old, you may only use the Service with the consent and supervision of a parent or legal guardian.

Our services are intended for personal health tracking and wellness improvement. You may use our services for lawful purposes only.
User Responsibilities
You are responsible for:
- Maintaining the accuracy of your health data
- Using the service responsibly and in accordance with these terms
- Protecting your account credentials
- Complying with applicable laws and regulations
Prohibited Activities
You may not:
- Misuse our services or attempt to disrupt our systems
- Violate any applicable laws or regulations
- Attempt to gain unauthorized access to our services
- Upload unlawful, harmful, offensive, or infringing content
- Reverse engineer or circumvent protections
6. Health Disclaimer
Not Medical Advice
Fuse and our services are not intended to diagnose, treat, cure, or prevent any medical conditions. Our services are for informational and tracking purposes only. All calorie estimates, nutritional insights, and health data are automated approximations and may be incomplete or inaccurate.
Consult Healthcare Professionals
Always consult with qualified healthcare professionals for medical decisions and advice. You should consult licensed professionals for dietary or medical guidance. Do not disregard professional medical advice or delay seeking it because of information from our services.
Emergency Situations
Our services are not designed for emergency medical situations. In case of medical emergencies, contact emergency services immediately (911 in the US).
7. User Content; License Grant
By submitting User Content, you represent that you own or have rights to it. You grant us a worldwide, royalty-free, sublicensable license to use, store, process, reproduce, modify, and create derivative works from your User Content solely to operate, maintain, and improve the Service, including internal AI model training. We do not publicly display your content without your express consent.
8. Intellectual Property
All content, features, and functionality of our services are owned by us and are protected by copyright, trademark, and other intellectual property laws. Your health data remains your property, and we will not claim ownership of any personal information you provide.
9. Privacy
Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information.
10. Subscriptions and Billing
If you purchase a subscription through the Apple App Store or Google Play Store, payment processing, billing, renewals, and refunds are handled by the applicable platform and are subject to that platform's terms and conditions.
Subscriptions automatically renew at the end of each billing period unless cancelled through your app store account settings at least 24 hours before the renewal date. You are responsible for managing and cancelling subscriptions through the platform where you made the purchase.
11. Limitation of Liability
We shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services. Our total liability to you for any claims shall not exceed the greater of the amount you paid for our services in the past 12 months.
12. "AS IS" Disclaimer
The Service is provided without warranties of any kind, express or implied. We disclaim all warranties including merchantability, fitness for a particular purpose, accuracy, and non-infringement.
13. Indemnification
You agree to defend, indemnify, and hold harmless us from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of our services.
14. Termination
We may terminate or suspend your access to our services immediately, without prior notice, if you breach these Terms of Service. Upon termination, all rights granted to you immediately cease.
15. Third-Party Services
The Service may include links or integrations with third-party content or services. We do not control and are not responsible for such services.
16. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles.
17. Changes to Terms
We reserve the right to modify these terms at any time. Material changes will be announced through reasonable notice. Continued use after updates constitutes acceptance.
